Membership Agreement

Users of this shopping website and customers who make purchases are deemed to have accepted the following terms: The web pages on our website and all pages linked to it (‘the Sites’) are the property of and operated by www.elektronixx.com (the Company). By using the services offered on the site, you (‘User’) acknowledge and agree that you are legally authorized to enter into a contract under the applicable laws, that you are over the age of 18, and that you have read, understood, and agreed to the terms set out in this agreement.
This agreement imposes rights and obligations on both parties regarding the site and, when accepted, the parties agree to fulfill these rights and obligations accurately, promptly, and in accordance with the conditions outlined in this agreement.
- Responsibilities
a. The Company reserves the right to make changes to prices, products, and services at any time.
b. The Company agrees and undertakes to ensure that the user benefits from the services related to the contract, except in cases of technical malfunction.
c. The User agrees not to engage in reverse engineering or attempt to find or obtain the source code of the site or engage in any action that would lead to acquiring such code. Otherwise, the User is responsible for any damages incurred by third parties and accepts the legal and criminal actions that may be taken.
d. The User agrees not to produce or share any content on the site that is contrary to public morals, violates the law, harms third-party rights, is misleading, offensive, obscene, pornographic, infringes on personality rights, violates copyright, or encourages illegal activities. Otherwise, the User will be fully responsible for any damages, and the site administrators have the right to suspend or block such accounts and initiate legal action. The site also reserves the right to share account information with authorities if requested.
e. The relationships between site members or between members and third parties are the sole responsibility of the user.
- Intellectual Property Rights
2.1. All intellectual property rights, whether registered or unregistered, including titles, business names, trademarks, patents, logos, designs, information, and methods on this site, belong to the site operator and the company or its designated affiliate, and are protected under national and international law. Visiting this site or using its services does not grant any rights to the intellectual property listed.
2.2. The information on the site may not be reproduced, published, copied, presented, or transmitted in any form. The whole or any part of the site cannot be used on another website without permission.
- Confidential Information
3.1. The Company will not disclose personal information provided by users on the site to third parties. Personal information includes data such as the user’s name, address, phone number, mobile number, email address, and any other information that may identify the user, collectively referred to as “Confidential Information.”
3.2. The User agrees and declares that the Company may share their communication, portfolio status, and demographic information with affiliates or group companies for promotional, marketing, campaign, or statistical purposes. This information may be used to create customer profiles, offer promotions, and conduct statistical research.
3.3. Confidential Information may only be disclosed to official authorities when required by law or when requested by the relevant authorities in accordance with the mandatory provisions of the law.
- No Warranty
To the fullest extent permitted by applicable law, the services provided by the Company are offered “as is” and “as available,” without any express or implied warranty, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Registration and Security
The User must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be deemed violated, and the User’s account may be closed without notice. The User is responsible for the security of their passwords and account information on the site and third-party sites. The Company is not responsible for any data loss, security breaches, or damage to devices caused by failure to maintain proper security.
- Force Majeure
Neither party will be responsible for any failure to fulfill its obligations under this Agreement due to reasons beyond their control, including natural disasters, fires, explosions, wars, revolutions, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages (collectively referred to as “Force Majeure”). During such events, the rights and obligations under this Agreement will be suspended.
- Integrity and Applicability of the Agreement
If any provision of this Agreement becomes partially or fully invalid, the remaining provisions will continue to be valid.
- Changes to the Agreement
The Company may modify the services offered on the site and the terms of this agreement at any time, in whole or in part. Changes will take effect upon publication on the site. It is the User’s responsibility to follow these changes. By continuing to use the services, the User is deemed to have accepted these changes.
- Notification
All notifications related to this Agreement will be made via the Company’s known email address and the User’s email address specified during registration. The User agrees that the address provided during registration is their valid notification address and that they will notify the other party within 5 days of any address change. Otherwise, notifications sent to the specified address will be deemed valid.
- Evidence Agreement
In case of any disputes arising from this Agreement, the books, records, documents, and computer records of the parties will be considered evidence under the Turkish Civil Procedure Code (No. 6100). The User agrees not to object to these records.
- Resolution of Disputes
The courts and enforcement offices of Istanbul (Central) are authorized to resolve any disputes arising from or related to the interpretation or application of this Agreement.
